Us, we, our etc. mean Fauvic Nurseries Ltd.
You, your, yours etc. mean You, the customer.
By accessing this website and / or placing an order or requesting a delivery you agree to be bound by the Terms and Conditions set out below. If you do not agree to be bound by these Terms and Conditions you may not use or access this website. We may change our Terms and Conditions at any time, so please do not assume that the same terms will apply to future orders/delivery requests.
To use our website you must accept delivery within our served area. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions. These terms and conditions do not affect your statutory rights.
Prices and GST
Please note that the prices on our website are guide prices only. The actual price you pay will be the price charged in store at the time your order is picked for delivery. The actual order value cannot be determined until the day of delivery because the prices stated on the website may vary either above or below the prices in store on the day your order is picked and delivered.
In the event a product is listed at an incorrect price due to an error or error in pricing information from our suppliers, we shall have the right to refuse or cancel any orders, or part of any orders, listed at the incorrect price whether or not the order has been confirmed.
All prices stated on the website are inclusive of GST. A total GST amount will be highlighted as a separate line on your invoice and will be included in the grand total, as shown on your invoice.
Payments
Any of the following cards may be used to pay for your shopping: Visa Debit (Delta), MasterCard, & Visa Credit.
Your card will be charged when you complete your order. Payment will be taken to cover the cost of all goods ordered at the in-store selling price prevailing that day, as well as the delivery charge, if applicable.
Delivery
We will charge £5.00 for the delivery of goods for orders under £30.00. Delivery is free for orders over £30.00.
We will make every effort to deliver all your goods in the agreed time, however; we will not be liable if we fail to do so in part or in full due to circumstances beyond our control. We shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of your order.
Order before 12:00 to ensure same day delivery or before 18.00pm on a Saturday evening for Sunday morning delivery.
If an order is placed after 12.00pm the order will be delivered the following working day unless specified otherwise.
Delivery time will be between 9.00am – 18.00pm.
We cannot deliver on a Bank Holiday or on any other Public Holiday applicable in Jersey.
We will not deliver to addresses outside Jersey.
Goods must be signed for at the delivery address by you, or by your nominated representative who must be aged 18 or above. Deliveries will not be made in your absence, and your order will be returned to the store. You may then collect your order from the store or arrange an alternative delivery time. Re-delivery will incur a delivery charge of £5.00.
As soon as we have delivered the goods to your door, or to a nominated person, you will be responsible for them. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk. Any transit damage to the goods, shortages or incorrect goods supplied must be noted on the delivery note at the time of delivery.
Returns & Refunds
You have the right to cancel your order at any time before it has been processed, free of charge.
While we hope you'll be happy with the items you order from our website, we know you may sometimes need to return them. Claims for damaged/poor quality/wrongly delivered goods must be notified to us within 24 hours of delivery otherwise they may not be considered. You are responsible for the return of the goods to us.
When you return the goods to us, please also let us have all the original packaging, tags, labels and any accessories. You will need to take reasonable care of item(s) whilst they are in your possession (reasonable care includes inspecting an item, but would not extend to your opening and/or using it). If you damage items whilst they are in your possession, there may be a deduction from your refund.
Availability of Goods
All orders are subject to availability and may be withdrawn at any time. If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you. Although we will always try to cater for your orders, information on the site detailing stock levels should not be viewed as a guarantee of availability, and is a guide only. If we cannot supply any item ordered, we will notify you as soon as possible. You will only be charged for items that are ordered. Your card will be credited for any goods not delivered.
Use of copyrighted material
The content of our website is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on this website.
Alcohol
To comply with licensing legislation the purchase of alcohol from this site is only available to those aged 18 and over. For this reason, we may refuse an order or refuse to make a delivery at our discretion. By placing an order for alcohol you confirm that you and the person the order is to be delivered to are aged 18 years or over. We will not deliver alcohol to anybody who appears to be under the age of 18 without valid photographic identification or to anybody who is outside of Jersey. We reserve the right to decline any order relating thereto.
In the event of an order of alcohol being placed by a person under the age of 18 or on behalf of a person under the age of 18 with intent to supply, we will report them to the authorities.
Other
Failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions. These terms and conditions are subject to change at any time without prior notice to you.
